City of Seguin Reminds Residents of Pool Ordinances
Regulations Apply to Pools and Spas Deeper than 24 inches

SEGUIN, Texas – As the temperature rises, so does the number of pools being installed across our area. The City of Seguin Planning/Codes Department reminds residents of the ordinances for swimming pools and spas.

“We want to make sure this information is fresh on the mind of residents as many consider installing a pool or spa,” Seguin Public Information Officer Scott Packard said. “Knowing these ordinances before you start work can save you and the city headaches.”

A swimming pool is defined as any structure intended for swimming or recreational bathing that contains water more than 24 inches deep. This includes in-ground, above-ground and on-ground swimming pools, hot tubs and spas.

* A 48 inch fence must surround swimming pools and spas. The maximum clearance under the fence shall be two inches. If a fence is mounted to the top of an above ground pool, the clearance between the top of the pool structure and the bottom of the fence shall not exceed four inches.

* Access gates shall comply with the above requirements and shall open outward from the pool area. The gate shall be equipped with a self-closing apparatus. Self-latching mechanism devises located less that 54 inches from the bottom of the gate shall be at least three inches below the top of the gate.
-The gate and barrier shall have no openings larger than half an inch within 18 inches of the mechanism.

* Where the wall of the dwelling services as part of the barrier, one of the following conditions shall be met:
- A powered safety cover in compliance with ASTM 1346 (standard performance specifications used for safety covers.)
- Doors with direct access to pool through that barrier shall be equipped with an alarm that produces an audible warning when the door or its screen is opened. The deactivation switch shall be 54 inches above the threshold.

* Entrapment protection suction outlets shall be designed and installed in accordance with ANSI/APSP-7 (standard performance specifications used for suction entrapment avoidance.)

Those discovered to be in violation of the ordinances will have to pay double the fee for a permit. If one is unable to obtain a permit, the pool must be removed.
